Who is Liable for my Injuries
The JW Marriott or The Rampart Casino are owned and operated by different companies.
They just assume that Marriott International owns and operates the hotel.
However, the name is leased and the hotel casino is owned and operated by another company.
There is always a possibility that more than one party played a part when you are injured at a hotel casino.
You just have to figure out who operates the hotel where you were injured but there may be other parties that you don’t even think of right off the bat.
Some of the most common third parties that may have some responsibility are:
-
The Hotel Construction Company
-
The hotel owners
-
The Furniture manufacturer
-
The food and liquor vendors
-
The escalators and elevator maintenance companies
-
The Valet parking company
-
Outside Security
-
Outside concert promoters
-
Restaurant owners and operators.
Many hotels like The Rampart lease space to restaurants and shops on their property to add other amenities for the guests.
These shops and restaurants are leased, so the casino owner is responsible for the land and the shop owner is responsible for what’s in the shop.
This all can all be very confusing and that’s why if you’re injured at a place like The Rampart Casino you should always seek legal advice as soon as possible.
Common Injuries at Rampart Casino Hotel
Since casino hotels are usually very big places with a lot of foot traffic there are some common injuries that most lawyers see regularly.
Smaller, more remote places like The Rampart may not have the foot traffic, but it is still a large scale casino space with a lot of opportunity for injuries and accidents.
Some of the most common accidents that are regularly reported are:
-
Slip and Fall accidents are the most common of the injuries reported.
-
Food poisoning is the second most reported hotel casino injury and can include food borne illness or items being stuck in food products like glass.
-
Escalator and elevator injuries, usually from poorly maintained elevators and escalators and can include getting stuck on / or in either. Falling down an escalator when clothing gets stuck is a common issue.
-
Pool related injuries are common since more Las Vegas Hotels have big pool areas and with the invention of the weekend pool party more people are flocking to the pools, leading to more pool injuries including drowning accidents.
-
Assaults by other patrons and sometimes even staff. Fights break out all the time in Vegas and over the years many security personnel have been accused of assaulting patrons for a variety of reasons.
-
Parking garage, valet, limo, and shuttle injuries are common since these areas are often overcrowded and understaffed. Every hotel has a shuttle designed to help guests get from point A to point B, however the driver might not have been trained properly or doesn’t have the proper license to drive a shuttle and a car accident might occur due to negligence.
These are just a few of the more common injuries that guests and employees face when working at or visiting a casino hotel in Las Vegas.
Some injuries can be minor and you may think nothing of it.
On the other hand there are cases where being hurt in a casino hotel can be a life changing event.
Damages From Injury at The Rampart Casino
Depending on the type and severity of your injuries you may be able to recover damages if the casino or other responsible party was negligent in their business practices and were the cause of your injuries.
Some forms of financial compensation that you can recover if injured while working or visiting a hotel and casino in Las Vegas are;
-
Medical expenses- this covers all medical expenses, current and future related to your injuries. This can be prescriptions, rehab treatments, hospital visits, ongoing care.
-
Lost wages- this will cover wages, salaries, tips and bonuses that you would of have earned had it not been for the accident. This can include future earnings that you will not earn if you are unable to return to work or are out for a significant period of time.
-

-

Our Las Vegas personal injury attorneys can help you determine what damages that you may be able to recover as a result of your injuries due to negligence.
Statute of Limitations After Being Injured in a Casino?
You may not even think you’re going to do anything after your injuries from being at a casino hotel.
Maybe you get home and start to realize the medical bills are adding up and this accident continues to linger and be an issue in your life.
You may think you have months to decide whether or not it’s a hassle to file a claim against the big casinos.
The truth is from the minute your accident happens the clock is ticking.
In Nevada you only have two years to file a claim after injury.
This statute of limitations is for all personal injury claims with few exceptions.
That means even if you’re from out of town and get injured you need to file within the Nevada statute of limitations of two years.
That’s why hiring a local legal expert is so important and to do it as soon as possible.
Rampart Casino Hotel History
Summerlin being the newest of the planned neighborhoods in Las Vegas is a community that has several golf courses and even a tennis club.
Summerlin is also the home of The Red Rock Casino resort.
But in the late 90’s and early 2000’s when Summerlin was just being built there was not a single casino hotel in the area yet.
In 1996 a plan was announced to open a casino, spa, hotel resort in the Summerlin area, known as The Resort at Summerlin.
Eventually after many delays due to construction and other issues the 548 room hotel opened in July of 1999.
Over the years it has had many names and has been bought and sold many times due to financial hardship.
Today however it is The JW Marriott La Vegas Resort and Spa. It is owned and operated by a Hot Spur Resorts that leases the Marriott name from Marriott international.
The Rampart or JW Marriott, depending on what the locals call it, set out to be a high roller draw away from the Strip.
However over the years the focus has turned to locals since the location is so far from any other strip locations.
The JW Marriott offers a huge spa facility that attracts customers from all over.
Since Marriott International doesn’t actually own and operate the property and The Rampart Casino is actually leased from the hotel owner, it can be difficult to figure out who is ultimately responsible if you were injured at The Rampart.
Hiring a personal injury expert can help you figure out who is ultimately the responsible party or parties.
