While driving home, a mother was rear-ended by a distracted driver, and she suffered an injury to her neck. After months of conservative treatment, she had surgery. Our firm made a time-limit demand for the defendant’s liability insurance policy limits, which were only $50,000. The insurance company refused to pay even though our client’s medical expenses were in excess of $50,000. The insurance company’s failure to pay was an act of bad faith against its insured, exposing the insurance company to the full extent of our client’s damages, regardless of the inadequate policy limits. An arbitrator determined our client’s full damages, and the defendant’s insurance company paid the entire amount.

A tractor-trailer spilled a load of trusses across the freeway. A father hit the trusses while driving his motorcycle to work, and he was ejected from his bike. He tumbled 171 feet from the initial point of impact and suffered numerous compound and crush fractures to his arms, hands, ribs, pelvis, legs, and feet, requiring multiple surgeries. An investigation revealed the truck driver failed to secure the load of trusses. The truss company also failed to provide the proper trailer to safely transport the load. A Las Vegas mobile home park advertised as a safe environment claimed to perform background checks on new residents. Tree Trimmer Electrocuted and Killed

A homeowner planted palm trees in her backyard under high-voltage power lines. The palm trees grew and interfered with the power lines, causing small fires in the trees. The local power company had a “line clearance” program to identify and remove trees that became hazards and sent a crew to remove the trees. The utility company had the legal right to remove hazardous trees without the homeowner’s permission, but as a courtesy, asked for permission. The homeowner refused. She hired a private party tree trimmer who, while trimming one of the trees, was electrocuted and died. His family asked our firm to help. We filed a lawsuit against the homeowner and utility company for negligently allowing the hazardous tree to remain on the premises.

Three family members and a friend died in a house fire, which started in an upstairs bedroom. The smoke detectors failed to warn of the spreading fire. The family also had purchased a heat detector with an alarm and smoke detectors. Both failed on the night of the fire. Security bars on the doors and windows failed to have release latches on the inside, so the family could not escape the fire. We filed a lawsuit against the various product manufacturers for defective designs.

TEENAGER INJURED BY DEFECTIVE DOOR HINGE

A 16-year-old passenger in a sports car was hurt in a collision when the passenger door hinge failed, allowing a large gap between the door and the dashboard. The teenager’s legs became entangled in the gap, severing them. Our firm’s investigation revealed that the vehicle had a defectively designed door hinge that allowed the doors to disconnect. The manufacturer knew about the defect and had redesigned the hinge. Our firm filed a lawsuit against the vehicle manufacturer.

STATE AND CAR MANUFACTURER NEGLIGENT FOR FAMILY’S ACCIDENT

On the way to church, a young father, his wife, and their eight-year-old son were sideswiped by a hit-and-run driver. The family’s pickup truck was forced into the freeway median and then into the path of an oncoming vehicle. All three family members were ejected from the vehicle. The young father was severely injured, and his wife and child were killed. The driver of the other vehicle also died.Our firm’s investigation, including expert witnesses, determined the state failed to construct a freeway median barrier which would have prevented the truck from being forced into oncoming traffic. The family’s truck also was not equipped with electronic stability control, which would have kept the vehicle from losing control. The truck did not have laminated glass, which would have kept the occupants inside during the collision. The truck’s seat backs and seat belts also failed to restrain the mother and child.

The child’s seat belt remained in its locked position, confirmed in photographs of the truck taken by the highway patrol at the scene.

We filed a lawsuit against the state and against the vehicle manufacturer for product liability. The hit-and-run driver was underinsured, and although the young father purchased multiple policies of stacking underinsured motorist coverage, his insurance company refused to pay. Our firm also filed a lawsuit against the father’s insurance company to force it to pay the full limits of coverage. This case was featured nationally on MSNBC.

TEENAGER PARALYZED IN ROOF CRUSH ACCIDENT

A 19-year-old teenager was a passenger in his friend’s truck when the friend ran a red light, and they were hit by another vehicle. The truck rolled over, the roof collapsed, and the teenager was paralyzed. The driver had inadequate auto insurance. The teen’s family had a small policy of underinsured motorist coverage, but the insurance company refused to pay the $25,000 policy. Our investigation revealed that the truck had a substandard A-pillar. This allowed the roof to collapse, crushing the passenger when the vehicle rolled. MECHANIC RUN OVER BY VEHICLE WITH FAULTY DESIGN

An auto mechanic was working on a customer’s car while the engine was running, and the vehicle was in park. The vehicle transmission slipped from park to reverse and rolled over the mechanic. He suffered multiple injuries, requiring several surgeries. He was permanently disabled. Our firm’s investigation revealed the customer’s car had a design defect in the automatic transmission shifting mechanism. This allowed a condition known as “false park” to occur. The gear indicator showed the vehicle was in park, but the transmission was actually between park and reverse, allowing it to easily slip into reverse. We filed a lawsuit against the vehicle manufacturer for defective design.

Infant Given Fatal Dose of Zinc at Hospital

A 3-week-old infant in a Las Vegas hospital neonatal intensive care unit was given a fatal dose of zinc intravenously. A hospital pharmacist incorrectly entered the prescription into a computerized solution compounding device, another pharmacist failed to catch the error. The technician who operated the compounding device added the fatal dose of zinc to the I.V. bag, and a third pharmacist and two hospital nurses also failed to notice the error. Investigations determined that the compounding device manufacturer considered, but failed to include, a mandatory lock-out or warning prompt in the software to prevent mistaken overdose selections. This case was featured nationally on ABC’s “Nightline,” “Inside Edition,” and in Portfolio magazine.
