The U.S Department of Transportation through the National Highway Traffic Safety Administration (NHTSA) announced today that it will require lap and shoulder belts for each passenger and driver of new motor coaches, and large busses.  This is an attempt to reduce deaths and injuries due to bus accidents.

U. S. Transportation Secretary Anthony Foxx declared after the rule was handed down, “Safety is our highest priority and we care committed to reducing the number of deaths and injuries on our roadways.

The Food and Drug Administration (FDA) working with the Centers for Disease Control and Prevention (CDC) have deemed the dietary supplements OxyElite Pro and VERSA-1 to be adulterated products and ordered that they be removed from store shelves and that warehouse stock be destroyed.  This comes after 56 cases of non-viral hepatitis were identified in the U.S. from users of these products, resulting in at least 1 liver transplant, with others waiting, and one death.

Johnson and Johnson Company (J&J), owner of DePuy Orthopedics, has tentatively agreed to a settlement of $4 Billion in cases related to the defective DePuy ASR artificial hip, it was revealed Tuesday.  While the settlement still requires approval of the court, this would represent one of the largest payouts for a product liability claim involving a medical device.

There are currently approximately 12,000 cases against J&J for this product, which was recalled from the market in 2010, after it became apparent that the product failed at a sharply higher rate than other similar products.

It seems every time we hear the news in Las Vegas, we’re saddened to learn of another pedestrian accident.  Just in the last week, we’ve had two teenage boys hit by a vehicle at Harmon and Jones yielding trips to the hospital with moderate injuries, a man attending to his stalled car at the side of the road, killed on I-15 near Primm, and most recently a 14 year old girl killed, and her two companions hospitalized, when a truck hit them while crossing Blue Diamond near Cimarron.

Let’s face it, Las Vegas is a town made for parties.  It’s pretty much the reason this oasis in the middle of the Mojave Desert exists.  And we do it well.  We have a lot of people who come here to party, in fact in 2012, Las Vegas had nearly 40 million visitors.  That amounts to almost 110,000 visitors per day.  Movies have been made about it, we’ve had advertising campaigns promoting that what happens here stays here, and regardless of where you live the in U.S., Las Vegas means party time, in pretty much any way that can be defined.

The National Sleep Foundation has declared November 3-10, 2013, as Drowsy Driving Prevention Week.  As you think about that, consider that the American Automobile Association Foundation for Traffic Safety, found in an article published in 2010 that 1 out of 6 deadly traffic accidents and 1 in 8 crashes requiring hospitalization were due to drowsy driving, making drowsy driving as large a problem as drunk driving.  A recent poll by the National Sleep Foundation found that 60% of Americans have driven while feeling sleepy and 37% admitted that they had fallen asleep at the wheel within the last year.

There’s probably not a more fear-invoking experience than being involved in an accident with a large semi- truck.  Something about being near a 53’ long trailer moving at highway speeds, makes car drivers use more caution.  This fear is probably well-founded.  Semi-trucks can carry loads in the 80,000 lb. range, and even though there are 18 wheels on the ground, stopping that kind of load when traveling 60 mph or more, is not an easy task.

Beyond a person’s instinctive reaction to something that large moving next to you on the road, there are statistics which back up the fear.

Each year almost 3,000 kids are treated in emergency rooms across the United States after swallowing a battery.  This amounts to one kid every 3 hours.  The number of serious injuries and death from battery ingestion has increased almost 9 times in the last 10 years.

A major factor in automobile accidents today, is the increase in distracted driving.  Distracted driving can be defined as “any activity that could divert a person’s attention away from the primary task of driving.”  The main types of distraction while driving include:

  • Visual – taking eyes off the road
  • Manual – taking hands off the wheel
  • Cognitive – interrupting concentration needed to drive

In fact, several activities have proven to be extremely dangerous and increase the risk of an accident.  These activities include using a cell phone, texting, and eating.

If you are injured or become ill on-the-job, you are probably covered under Nevada’s Worker’s Compensation laws.  Most workers have heard the term, but few know whether the law covers them, or how benefits are claimed until, or in some cases after, they need to use it.  Due to this lack of knowledge, many times, deadlines are missed and benefits go unclaimed.

Nearly 4.7 million people in the U.S. are bitten by dogs each year.  One out of five dog bites are serious enough to require medical care, with nearly 1,000 people a day requiring emergency room treatment for the injuries.  In 2012, 27,000 people sustained injuries from dog bites serious enough to require reconstructive surgery.  Also in 2012, 38 people died due to dog bite injuries.

While dogs are considered “man’s best friend”, there are two breeds which can be considered deadly.  Pit Bull Terriers and Rottweiler’s are the deadliest breeds, accounting for 73% of fatal dog attacks during the years 2005 to 2012.

We last posted on this subject on April 10, 2013, and provided a link to a document published by the Nevada Office of Traffic Safety (OTS).  The weekly Fatal Analysis Reporting System or FARS update,  which is a report detailing the total car crashes and fatalities in all counties of Nevada at that time showed a marked increase in traffic accidents and fatalities from 2012 to 2013 to date.  The most recent report dated July 17, show improvements across the board, with only a few exceptions, since our last post.

It has been hailed as a miracle of modern medical science.  But this miracle costs $1.5 million to $3 million depending on the options ordered, and requires its owners to pay over $100,000 or more per year in service agreements, not to mention costs of the one-time-use attachments that are required to maintain and use the da Vinci® Robot.

This miracle is made possible by a company called Intuitive Surgical, Inc., located in Sunnyvale, CA, in fact, the da Vinci® Robot and its various attachments are the company’s only product line.  The da Vinci® is a 3 or 4 robotic armed device controlled by a surgeon sitting at a video console a few feet away from the patient rather than standing over them as in conventional surgeries.  The surgeon controls the robotic arms of the device by hand and foot controllers, rather than conventional surgical instruments.

Since the beginning of 2013, two major defective products lawsuits have been reviewed by the Judicial Panel on Multi-District Litigation (JPML).  As a result of that review, the panel has transferred all federal level suits for the Mirena IUD and for the contraceptive NuvaRing to their own respective Multi-District Litigation (MDL) cases.  Federal Mirena cases will be transferred to MDL No. 2434, and Federal NuvaRing cases are transferred to MDL No. 1964.

Women who suffer from conditions known as Pelvic Organ Prolapse (POP), and Stress Urinary Incontinence (SUI) may have had their doctor suggest use of a transvaginal mesh product when treating these conditions.  The Food and Drug Administration (FDA), in July, 2011, updated a Safety Communication regarding this product, and found: “that serious complications associated with surgical mesh for transvaginal repair of POP are not rare.”

What are these serious complications?  Most often they are related to mesh migration and erosion, with the mesh often moving through the wall of the vagina or other abdominal organs, which results in pain, infection, bleeding, painful sexual intercourse, organ perforation and urinary problems.
